California’s Structure mirrors the thirteenth Modification of the U.S. Structure, which permits for involuntary servitude as punishment for crime. A rising record of states have handed related initiatives that eliminated involuntary servitude as punishment for crimes from their state constitutions. These states embody Vermont, Oregon, Tennessee, Alabama, Nebraska, Utah, and Colorado.
Prison justice reform advocates have been pushing for a change to the language within the Structure for years, saying it permits the California Division of Corrections and Rehabilitation to require able-bodied inmates to work for as little as 35 cents an hour.
The primary push to take away that exception from the state Structure stalled in 2022 as a result of lawmakers feared it could price billions. After the hassle was discarded, Assemblymember Lori D. Wilson (D-Suisun Metropolis), chair of the Legislative Black Caucus, introduced again the measure final 12 months as one among 14 payments to advance reparations for the descendants of enslaved African People.
This measure would make jail work non-compulsory by instituting a voluntary work program.
